  The enacting of the Human Rights Act has opened up new possibilities for practices who suffer the unwelcome advances of pharmacy into their practice areas.

Such practices, if attacked through the "loophole" arbitrarily suffer a huge loss in their income without any right of defence.

Whether the chemist's approach is through Clothier or the "loophole", if it succeeds not only will the practice lose income but there will be no compensation from either the chemist or the NHS which drew up the regulations.

It is estimated that £4,500 will be needed approach reputable counsel (Cherie Blair's Matrix Chambers was suggested elsewhere on this site).    If 100 practices contributed £50 each, dispensing practice via countrydoctor would be in business.    Equally, 50 practices could contribute £100 each.   Whichever is decided it would be an enormous bargain and a massive contribution to the future of dispensing by doctors in the UK.

An added benefit is that the nonsense of the DDA Ltd's "trade-off" treachery with pharmacy would be entirely unnecessary.  The latest information is that, for the time being, those negotiations have stalled.

Please pass this message (and the site) to your neighbouring dispensing practices.  Let's get the ball rolling today.

A word of caution, however.   Lawyers and solicitors have bottomless pockets - YOURS!     A very good reason for a large number of practices contributing very little rather than a small number....
